Terms and Conditions

1. Quote Acceptance

  • This quote is valid for 15 days from its issue date due to constant changes in material prices.
  • Quote acceptance is confirmed by paying a 40% deposit of the total amount upon acceptance.

 

2. Prices and Payments

  • The prices indicated in this quote are expressed in euros and include VAT.
  • Payment must be made by bank transfer under the following terms:
  • 40% of the total quote amount as a down payment upon acceptance of the quote.
  • 50% of the total amount must be paid before or upon delivery of the materials.
  • The remaining 10% upon completion of the total work.
  • In the event of late payment, we will apply 1% daily interest on the outstanding amount. If you anticipate difficulties in making payment, please contact us to find a mutually beneficial solution.

 

3. Delivery and Execution Times

  • Kitchen cabinet delivery times and estimated renovation times will be provided once the quote has been accepted and may be subject to change. We undertake to inform the customer of any unforeseen delays.
  • We are not responsible for delays caused by circumstances beyond our control, such as supply issues, natural disasters, adverse weather conditions, etc.
  • Installation and renovation work will be carried out on weekdays and during business hours, unless otherwise agreed in writing.

 

4. Warranties and Returns

  • We offer a 2-year warranty on installation and supplied materials, in accordance with legal regulations.
  • Furniture is covered by a manufacturer’s warranty of up to 7 years, with a document specifying the terms.
  • Appliances, countertops, and other materials are covered by each manufacturer’s legal warranty.
  • The warranty does not cover damage caused by improper installation by third parties, misuse, or unauthorized modifications.
  • In the event of defects, the customer must notify us in writing within 15 days of receiving the product or completing the work.
  • Returns will not be accepted without prior proof of the incident and written authorization. Products must be returned in their original packaging and in optimal condition.
  • To activate the guarantee, full payment must be made. Without this, the final invoice cannot be issued and the warranty will be inactive.

 

5. Cancellations

  • In the event of cancellation by the client, a penalty of 40% of the total amount of the accepted estimate or the deposit amount will be applied.
  • Cancellations must be notified in writing at least 30 days prior to the start date of work or delivery of the product. Otherwise, the costs incurred up to the date of cancellation will be billed to the client.

 

6. Intellectual Property

  • All intellectual property rights in the designs, drawings, and products developed will remain the property of Mondial Cucine until all invoices issued to the client have been fully paid.
    In the event of the sale of the project, the intellectual property rights will be transferred to the client once payment has been made.
  • The client is not authorized to copy, reproduce, or otherwise use the designs or products without our prior written consent.

 

7. Confidentiality

  • Both parties agree to maintain the confidentiality of all information and documentation exchanged in connection with this quote and the execution of the work or service. This includes, but is not limited to, the prohibition on taking and/or disclosing photographs or images of the projects without the prior written consent of the other party. Any use of confidential information, including images, must be approved by both parties to ensure respect for privacy and data protection.

8. Client Responsibilities

  • The Client must ensure that the area where the renovations or furniture installation will be carried out is clear and ready for work.
    Any delays caused by a lack of preparation of the area will be the Client’s responsibility.
  • The Client must provide access to the worksite during the agreed-upon hours and ensure the availability of basic services such as electricity and water.

 

9. Applicable Law and Jurisdiction

  • These terms and conditions shall be governed by and construed in accordance with the laws of Spain.
  • Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

 

10. Others

  • Any modifications to these terms and conditions must be agreed to in writing by both parties.
  • In the event that any provision of these terms and conditions is declared invalid or unenforceable, the remaining provisions will remain valid and enforceable.

11. Quote Verification and Adjustments

  • Once the quote has been accepted, we will carry out an on-site inspection of the home or construction site to ensure that all details and measurements are correct and complete. If any discrepancies or adjustments are identified during this review, we will work together to find the best possible solution. This may involve changes to the budget, in which case we will clearly communicate any necessary adjustments.
